Important notice for EU and EEA consumers
Nothing in these Terms limits or excludes any mandatory rights you have under the consumer protection laws of your country of residence. Where your local law provides greater protection than these Terms, your local law applies. This includes rights under the EU Consumer Rights Directive (2011/83/EU), the Unfair Contract Terms Directive (93/13/EEC), and national implementations thereof.
Overview
AESKA is operated by AOE Ecom AB, a company registered in Sweden. Throughout these Terms, "we", "us", and "our" refer to AOE Ecom AB trading as AESKA. Our store is hosted on Shopify, which provides the e-commerce platform enabling us to sell products globally.
These Terms of Service, together with our Privacy and Cookie Policy and Return and Refund Policy, govern your access to and use of aeska.co and all related services (the "Services").
By visiting, accessing, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
Section 1 - Access and accounts
By using our Services, you confirm that you are at least the age of majority in your country, state, or province of residence, or that you have obtained consent for any minor dependents to use the Services under your supervision.
To make purchases, you may be required to provide your name, email address, billing and shipping details, and payment information. You represent that all information provided is accurate, current, and complete, and that you have the legal right to provide it.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Accounts may not be transferred, sold, or assigned to another party.
Section 2 - Products
We make every effort to accurately display and describe our products, including colors, dimensions, and materials. However, the appearance of products may vary depending on your device, screen settings, and display configuration. We do not warrant that product images are perfectly accurate representations of the physical product.
All product descriptions and availability are subject to change at any time without notice. We reserve the right to limit quantities or discontinue any product at our sole discretion.
EU/EEA consumers: our products come with a statutory 2-year conformity guarantee under EU law (Directive 2019/771/EU). If your product is faulty or does not conform to the contract description within 2 years of delivery, you are entitled to a remedy. This is in addition to any rights under our Return and Refund Policy.
Section 3 - Orders and contract formation
By placing an order, you are making an offer to purchase. We reserve the right to accept or decline any order for any reason, including suspicion of fraud, stock unavailability, or errors in pricing.
A binding contract is formed only when we have processed your payment and sent you an order confirmation. You will receive this confirmation by email.
Products purchased through our Services are intended for personal or household use only and may not be resold or exported for commercial purposes without our prior written consent.
EU/EEA consumers: if you placed an order and did not receive a confirmation email within 24 hours, please contact us at support@aeska.co before assuming your order was accepted. Under EU law, the contract is formed when we accept your offer, not when you submit it.
Section 4 - Pricing and payment
Prices are displayed in the currency shown at checkout. Prices, promotions, and availability may change without notice. The price shown and confirmed at checkout is the price you will be charged.
You agree to provide accurate billing and payment information and authorize us to charge your selected payment method for all applicable fees, including the product price, applicable taxes, and shipping costs as displayed at checkout.
If a pricing error occurs, we reserve the right to cancel the order and notify you. We will offer you the opportunity to re-order at the correct price.
Section 5 - Taxes, customs duties, and import fees
5.1 - Taxes we collect
AESKA collects and remits applicable taxes in jurisdictions where we are required to do so. This includes VAT in most EU member states (via the OSS scheme), VAT in the United Kingdom, GST in Australia and New Zealand, and sales tax in applicable US states. Where we collect tax, it will be displayed separately at checkout and included in your final order total.
5.2 - Orders shipped from overseas
Some orders are shipped directly from our fulfillment partners overseas (including from China). In these cases, depending on your country's import regulations and the value of your order, you may be classified as the importer of record and may be liable for:
- Import duties or customs tariffs levied by your local customs authority
- VAT or GST assessed at the point of import (in addition to or instead of what was collected at checkout)
- Carrier handling or customs brokerage fees
These charges are outside our control and are not refundable by AESKA, as they are collected directly by your local authority or carrier.

5.3 - Country-specific notes
European Union
We collect VAT in most EU countries at checkout. However, for orders shipped directly from outside the EU, local import VAT and duties may still be assessed by customs. Contact us before ordering if you are unsure.
United States
Sales tax is collected at checkout in applicable states. For shipments from overseas, the US de minimis threshold currently allows duty-free import for most low-value orders, but thresholds and rules are subject to change. Verify current rules with CBP before ordering.
United Kingdom
UK VAT is collected at checkout. Import duties under the UK Global Tariff may apply for certain products or order values.
Canada
GST/HST may apply. Canada Border Services Agency may assess duties depending on product category and order value.
Australia and New Zealand
GST is collected at checkout. Additional customs duties may apply for orders above local import thresholds.
Switzerland
Switzerland is not part of the EU VAT area. Import VAT and customs duties are likely to apply. We strongly recommend contacting us before placing an order.
5.4 - Non-delivery due to customs refusal
If a shipment is refused, seized, or returned by customs due to your failure to comply with import regulations, pay applicable duties, or provide required documentation, you bear responsibility for any resulting costs. In such cases, we are not obligated to issue a refund for the original order, though we will assess each situation on a case-by-case basis and aim to find a fair resolution.
Section 6 - Shipping and delivery
All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs clearance, weather, strikes, or other events beyond our reasonable control.
Once an order is handed to the shipping carrier, risk of loss passes to you as the customer. If your order is lost or damaged in transit, please contact us and we will work with you to find a resolution.
EU/EEA consumers: under EU law, risk of loss does not pass to you until you (or a third party you have nominated) have taken physical possession of the goods. If the carrier loses your order, the risk remains with us and we will provide a remedy.
Section 7 - Right of withdrawal (EU and EEA consumers)
This section applies specifically to consumers in the EU and EEA. It reflects your mandatory rights under Directive 2011/83/EU and cannot be waived.
If you are an EU or EEA consumer, you have the right to withdraw from your purchase within 14 calendar days of receiving your order, without giving any reason. Our Return and Refund Policy gives you 30 days, which exceeds the statutory minimum.
To exercise your right of withdrawal, contact us at support@aeska.co before the withdrawal period expires. You may use the following model withdrawal statement:
Refunds will be issued within 14 days of receiving your returned goods or proof of return shipment. You are responsible for the direct cost of returning the goods (a flat $6 return fee applies - see our Return and Refund Policy). The right of withdrawal does not apply to certain categories such as sealed hygiene products that have been opened.
Section 8 - Intellectual property
All content on the Services - including text, images, graphics, logos, designs, videos, and software - is the property of AOE Ecom AB or its licensors and is protected by applicable intellectual property laws, including trademark and copyright.
You may use the Services for personal, non-commercial purposes only. No content may be copied, reproduced, distributed, or commercially exploited without our prior written consent. Unauthorized use may result in legal action.
Section 9 - Third-party tools and links
We may provide access to third-party tools and links to external websites. These are provided without warranties of any kind. We are not responsible for the content, accuracy, privacy practices, or security of any third-party tools or websites.
Your use of third-party tools and websites is at your own risk and subject to those third parties' own terms and privacy policies.
Section 10 - Relationship with Shopify
Our store is hosted on Shopify Inc. All purchases are made directly with AOE Ecom AB. Shopify is not a party to and is not responsible for any aspect of your transactions with us. You expressly release Shopify from any claims related to purchases made through our Services.
Shopify processes certain personal data as our data processor. See our Privacy and Cookie Policy for more information.
Section 11 - Privacy and cookies
Your personal information is handled in accordance with our Privacy and Cookie Policy. By using the Services, you acknowledge that you have read and understood our Privacy and Cookie Policy. For EU/EEA users, certain data processing (such as marketing cookies) requires your explicit consent, which is obtained through our cookie consent banner.
Section 12 - User content and feedback
Any feedback, reviews, or suggestions you submit may be used by us without restriction or compensation. You represent that you own or have the necessary rights to any content you submit and that it does not infringe any third-party rights or applicable laws.
Reviews submitted to third-party platforms such as Trustpilot are subject to those platforms' own terms of service.
Section 13 - Errors and inaccuracies
Occasionally, information on the Services may contain typographical errors, inaccuracies, or omissions. We reserve the right to correct errors and update information at any time. If a pricing error affects your order, we will notify you and offer the option to proceed at the correct price or cancel.
Section 14 - Prohibited uses
You may not use the Services to:
- Violate any applicable laws or regulations
- Infringe intellectual property or other rights of any party
- Transmit malicious code, spam, or unauthorized communications
- Engage in fraud, misrepresentation, or unauthorized data collection
- Interfere with the operation or security of the Services
- Purchase products for unauthorized commercial resale or export
Section 15 - Termination
We may terminate or suspend your access to the Services at any time, without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Obligations incurred prior to termination remain enforceable.
Section 16 - Disclaimer of warranties
The Services and all products are provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
This disclaimer does not apply to the extent prohibited by applicable law. EU/EEA consumers retain the statutory 2-year conformity guarantee. Australian consumers retain rights under the Australian Consumer Law. These rights cannot be disclaimed.
Section 17 - Limitation of liability
To the fullest extent permitted by applicable law, AOE Ecom AB and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services or products, including loss of profits, data, or goodwill.
Our total liability to you for any claim arising out of or relating to these Terms or your use of the Services shall not exceed the amount you paid for the order giving rise to the claim.
This limitation does not apply where prohibited by law. EU/EEA consumers: this clause does not affect your statutory rights, including rights to remedies for defective goods or your right of withdrawal. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
Section 18 - Indemnification
You agree to indemnify, defend, and hold harmless AOE Ecom AB, Shopify, and their respective affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, costs, or expenses (including reasonable legal fees) arising from:
- Your breach of these Terms
- Your violation of any applicable law or third-party rights
- Your failure to comply with import regulations or customs requirements in your country
Section 19 - Dispute resolution
If you have a complaint or dispute, please contact us first at support@aeska.co. We aim to resolve all customer issues promptly and fairly without the need for formal proceedings.
EU/EEA consumers: you also have the right to use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr to resolve disputes with online traders. Our email address for ODR purposes is support@aeska.co.
Swedish consumers may also contact the Swedish National Board for Consumer Disputes (ARN) at arn.se.
Section 20 - Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law principles. Any disputes arising under these Terms that are not resolved informally shall be subject to the exclusive jurisdiction of the Swedish courts, specifically the District Court of Skaraborg (Skaraborgs tingsrätt) as the court of first instance.
EU/EEA consumers: this governing law clause does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence. You may also bring proceedings in the courts of your country of residence. US consumers: some states (including California and New Jersey) limit the enforceability of forum selection clauses in consumer contracts - your statutory rights under state law are not affected.
Section 21 - General provisions
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire agreement
These Terms, together with our Privacy and Cookie Policy and Return and Refund Policy, constitute the entire agreement between you and AOE Ecom AB regarding the Services.
Assignment
You may not transfer or assign these Terms or any rights hereunder without our prior written consent. We may assign these Terms without restriction, for example in connection with a business sale or restructuring.
No waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
Section 22 - Changes to these Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. For material changes, we will provide notice as required by applicable law. Your continued use of the Services following any posted changes constitutes acceptance of the revised Terms. If you do not agree to the changes, you should stop using the Services.
